1. Introduction and Acceptance of Terms

By accessing or using the LightDrive.one website, applications, or related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and all policies referenced herein, including our Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms from time to time. Material changes will be posted on our website and reflected by an updated Effective Date. Your continued use of the Services constitutes acceptance of the updated Terms.

Notices required under these Terms will be provided via email or through the Services and are deemed given when delivered.

2. Definitions

  • Account: A registered user profile with associated credentials and settings.
  • Content: Any data, files, text, images, video, audio, or other materials uploaded or created by a user.
  • Inactive Account: A free account with no user-initiated activity for 12 consecutive months. Paid accounts are never considered inactive.
  • Services: LightDrive.one offerings, including email, cloud storage, calendars, notes, tasks, file sharing, contacts, audio/video calls, and WebDAV/CalDAV/CardDAV access.
  • Subscription: A paid service tier providing enhanced features.
  • Third-Party Services: External services integrated to support LightDrive.one.
  • User: Any individual or entity accessing the Services.
  • Pricing Schedule: The published page describing subscription plans, pricing, and features.

3. Eligibility and Account Registration

To use the Services, you represent that:

  • Minimum Age: You are at least 13 years old, or the minimum age required in your jurisdiction, and have parental consent if required.
  • Legal Capacity: You have the legal capacity to enter into a binding agreement.
  • Accurate Information: Registration information is accurate and kept up to date.
  • Account Responsibility: You are responsible for all activity under your account and must safeguard your credentials.
  • Compliance: LightDrive.one may suspend or terminate accounts that violate these Terms.

By creating an account, you confirm that you meet these requirements.

4. User Responsibilities

You agree to:

  • Maintain the confidentiality of your credentials
  • Use the Services lawfully and responsibly
  • Comply with all applicable laws and LightDrive.one policies
  • Refrain from harmful, fraudulent, or abusive activity

5. Service Description and Availability

The Services are provided “as is” and “as available.” We strive for reliability but do not guarantee uninterrupted or error-free operation.

We may modify, suspend, or discontinue any part of the Services at any time.

6. Acceptable Use

You may not use the Services to:

  • Engage in illegal, harmful, or fraudulent activity
  • Infringe intellectual property rights
  • Promote or support terrorism or violent acts
  • Assist criminal activity or cause harm to people or property

Violations may result in immediate suspension or termination.

7. User Content and Intellectual Property

  • Ownership: You retain full ownership of your Content.
  • Limited License: You grant LightDrive.one a limited, non-exclusive, royalty-free license to host, store, and process Content solely to operate and improve the Services.
  • No Data Mining or Sale: Your Content is never used for advertising, profiling, or unrelated commercial purposes.
  • Protection: We implement safeguards to protect your Content from unauthorized access.

8. Data Retention and Deletion

  • Active accounts retain data while in use.
  • Inactive free accounts may be archived or deleted after 12 months, with at least 30 days’ notice.
  • Paid accounts are never deemed inactive.
  • Backup copies are retained temporarily for recovery purposes.
  • You may request data export or deletion per our Privacy Policy.

9. Payment Terms (Paid Services)

  • Fees are billed in advance on a recurring basis.
  • Prices and features are defined in the Pricing Schedule.
  • Downgrades take effect at the next billing cycle.
  • If data exceeds downgraded limits:
    • Uploads may be restricted
    • A 30-day grace period applies
    • Excess data may be archived or deleted if unresolved
  • No refunds are provided for any subscription fees.

10. Third-Party Services

LightDrive.one integrates trusted third-party providers for infrastructure, payments, and notifications. These providers are bound by contractual obligations and limited access.

11. Disclaimers and Limitation of Liability

The Services are provided without warranties of any kind. To the maximum extent permitted by law:

  • LightDrive.one is not liable for indirect or consequential damages.
  • Total liability shall not exceed fees paid in the prior 12 months.

12. Indemnification

You agree to indemnify and hold harmless LightDrive.one and its affiliates from claims arising from your use of the Services or violation of these Terms.

13. Termination

  • By You: You may close your account at any time; fees are non-refundable.
  • By LightDrive.one: We may suspend or terminate accounts for violations.
  • Effect: Access ceases immediately; data handled per retention policy.

14. Changes to Services or Terms

We may modify the Services or these Terms. Continued use constitutes acceptance.

15. Privacy

Your use of the Services is governed by our Privacy Policy.

16. Dispute Resolution and Governing Law

Disputes will first be addressed informally. If unresolved, they will be resolved by binding arbitration in Iowa. These Terms are governed by Iowa and U.S. federal law.
